1. Introduction

1.1 These Terms and Conditions ("Terms") govern the provision of services by Finding Mona Lisa ("Company") to the client ("Client") in connection with mobile paint parties ("Services").

1.2 By booking the Services, the Client agrees to be bound by these Terms.

 

2. Booking and Payment

2.1 The Client must make a deposit of $150 to secure the booking for parties with up to 20 participants. For parties with more than 20 participants, the deposit must be 20% of the total amount due.

2.2 The remaining balance must be paid in full at least 48 hours before the date of the party.

2.3 Payment can be made by cash, check or credit (credit card payments will incur a 3% fee)

2.4 In the event of cancellation by the Client, the following cancellation fees apply:

- Cancellation more than 10 days before the party: loss of deposit

- Cancellation less than 48 hours days before the party: full payment due

 

3. Party Preparation

3.1 Finding Mona Lisa will provide all necessary equipment and supplies for the paint party.

3.2 The Client must provide a suitable location for the party, with adequate space, tables, and chairs for all guests.

3.3 The Client is responsible for ensuring that the location is clean and free from hazards.

3.4 The Client must inform the Company of any special requirements, such as accessibility needs or dietary restrictions of guests, at least 24 hours before the party.

 

4. Liability

4.1 The Company will take reasonable steps to ensure the safety of all guests and the protection of the property of the Client and the guests.

4.2 The Client agrees to indemnify and hold harmless Finding Mona Lisa and its employees and agents from any loss, damage, or injury arising from the provision of the Services, except to the extent caused by the gross negligence or willful misconduct of Finding Mona Lisa.

4.3 Finding Mona Lisa's liability to the Client, whether in contract, tort, or otherwise, is limited to the amount paid by the Client for the Services.

 

5. Intellectual Property

5.1 Finding Mona Lisa retains all intellectual property rights in the designs and artwork created during the paint party.

5.2 The Client may not reproduce, distribute, or sell any of the designs or artwork without Finding Mona Lisa's prior written consent.

 

6. Privacy

6.1 Finding Mona Lisa will collect and process personal information about the Client and guests in connection with the provision of the Services.

6.2 Finding Mona Lisa will use such information only for the purpose of providing the Services and will not disclose it to any third parties, except as required by law or with the Client's consent.

6.3 Finding Mona Lisa may take photographs and/or videos during the party for the sole purpose of promoting its business through social media, website, and advertising.

6.4 The Client consents to the use of any photographs or videos taken by Finding Mona Lisa during the party for the sole purpose of promoting its business through social media, website, and advertising.

 

7. Governing Law and Jurisdiction

7.1 These terms and conditions shall be governed by and construed in accordance with the laws of the State of California.

7.2 Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the State of California.

 

8. Miscellaneous

8.1 These Terms constitute the entire agreement between the Client and Finding Mona Lisa and supersede all prior negotiations, understandings, and agreements between the parties.

8.2 No amendment or variation of these Terms shall be effective unless in writing and signed by both parties.

8.3 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8.4 These Terms shall be binding upon and inure to the benefit of the parties and their respective successors.

 

9. Participant Count and Refunds

9.1 The Client must confirm the final number of participants at least 72 hours before the party.

9.2 If the number of participants is less than the number confirmed by the Client, the Client will still be liable for the full payment.

9.3 If the number of participants is greater than the number confirmed by the Client, Finding Mona Lisa may, at its discretion, accommodate the additional participants at an additional cost.

9.4 No refunds or adjustments will be made for any reduction in the number of participants after the final confirmation.
